TERMS OF SALE

These Terms of Sale (“Terms”) apply to all photography services, sessions, packages, products, digital images, and related services purchased or booked through Forbidden Creations Co. (“Photographer,” “we,” “us,” or “our”).
By booking a session, signing a photography agreement, submitting payment, or purchasing photography services from Forbidden Creations Co., the client (“Client,” “you,” or “your”) acknowledges and agrees to these Terms, together with any additional terms contained in the applicable photography contract, invoice, booking form, or package description.
1. BOOKINGS & RETAINERS
A booking is not considered confirmed until the required retainer has been received and, where applicable, the photography agreement has been signed.
Dates and times are available on a first-booked, first-secured basis. An inquiry, quote, or discussion regarding availability does not reserve a date.
The required retainer will be identified at the time of booking and will be applied toward the total cost of the photography services.
Unless otherwise required by applicable law or expressly agreed to in writing, retainers are non-refundable because they compensate Forbidden Creations Co. for reserving the date and declining other potential bookings for that time.
2. PAYMENT
All prices are listed in Canadian dollars unless otherwise stated.
Payment schedules may vary depending on the service or package purchased. The Client agrees to pay all amounts according to the payment schedule shown on their invoice or photography agreement.
Unless otherwise specified, the remaining balance must be paid in full before photography services are provided.
Forbidden Creations Co. may decline to photograph a session, wedding, event, or other booking when an outstanding balance remains unpaid.
Additional services, coverage time, travel, products, rush editing, or other upgrades requested by the Client may result in additional charges.
3. CANCELLATIONS
Cancellation requests must be provided to Forbidden Creations Co. in writing.
If the Client cancels a booking, any amounts already earned, including an applicable booking retainer, may be retained by Forbidden Creations Co. subject to the photography agreement and applicable law.
Payments made toward services that have already been performed are non-refundable.
Any refund otherwise provided will be determined according to the circumstances of the booking, the applicable photography agreement, and applicable law.
4. RESCHEDULING
Forbidden Creations Co. understands that unexpected circumstances occur and will make reasonable efforts to accommodate rescheduling requests.
Rescheduling is subject to Photographer availability and is not guaranteed.
Repeated rescheduling, significant changes to the booking, or requests to move a session outside the originally agreed booking period may require a new retainer or booking fee.
For weddings, elopements, events, or other date-specific bookings, changing the event date is subject to Photographer availability. If Forbidden Creations Co. is unavailable for the new date, the change may be treated as a Client cancellation.
5. WEATHER
Outdoor sessions may be affected by weather conditions.
Forbidden Creations Co. will determine, using reasonable professional judgment, whether conditions are suitable and safe for photography.
Cloudy weather, wind, light rain, seasonal conditions, temperature, smoke, haze, or other ordinary environmental conditions do not automatically qualify a session for cancellation or rescheduling.
If conditions are unsafe or make the planned session reasonably impossible, Forbidden Creations Co. may offer an alternate date, time, or location.
6. CLIENT LATENESS & NO-SHOWS
Clients are responsible for arriving at the agreed location on time and prepared for their session.
If the Client arrives late, the session may still end at the originally scheduled time because another booking or commitment may follow.
Additional time is not guaranteed.
Clients who fail to attend their session without reasonable notice may forfeit amounts paid and may be required to make a new booking and payment before another session is scheduled, subject to applicable law.
7. PHOTOGRAPHER CREATIVE CONTROL
By booking Forbidden Creations Co., the Client acknowledges that they have reviewed and are familiar with the Photographer’s portfolio and artistic style.
Forbidden Creations Co. retains creative discretion regarding posing, composition, lighting, locations, equipment, image selection, cropping, colour grading, retouching, editing, and the overall artistic treatment of the final gallery.
Specific inspiration photographs or shot requests may be provided and will be considered; however, an exact recreation or specific photograph cannot be guaranteed.
8. IMAGE SELECTION & EDITING
Forbidden Creations Co. will select the photographs considered suitable for delivery based on professional and artistic judgment.
Images that are duplicates, test photographs, missed focus, unflattering expressions, technically unsuitable, or otherwise inconsistent with the Photographer’s professional standards may be removed during the selection process.
The number of photographs delivered may vary unless a specific guaranteed quantity is included in the purchased package.
Editing reflects the current artistic style of Forbidden Creations Co.
Requests for substantial additional retouching or re-editing may be subject to an additional fee.
9. RAW & UNEDITED FILES
RAW, unedited, rejected, or otherwise unfinished photographs are not included with photography services and will not be provided unless Forbidden Creations Co. expressly agrees otherwise in writing.
The Client’s purchase is for the finished photographic work and services described in the applicable package—not every image captured during the session.
10. DELIVERY & TURNAROUND
Estimated turnaround times may vary depending on the type of photography service, season, workload, gallery size, and other circumstances.
Any turnaround estimate provided by Forbidden Creations Co. is an estimate unless a specific delivery deadline is expressly guaranteed in writing.
Forbidden Creations Co. will make reasonable efforts to notify the Client of significant unexpected delays.
Sneak peeks or preview photographs are provided at the Photographer’s discretion unless specifically included in the Client’s package.
11. ONLINE GALLERIES
Digital galleries may remain available for a limited period.
Clients are responsible for downloading and securely backing up their final photographs before their gallery expires.
Forbidden Creations Co. is not responsible for permanently storing Client photographs after the applicable gallery or archival period has ended.
If archived files remain available, restoration or gallery reactivation may be subject to an administrative or archival fee.
12. COPYRIGHT & PERSONAL USE
Unless expressly transferred in writing, Forbidden Creations Co. retains copyright in photographs created by the Photographer.
Purchasing photography services does not constitute a transfer of copyright.
Clients receiving digital photographs are granted a personal-use licence allowing them to download, print, display, and share their photographs for personal, non-commercial purposes.
Clients may not sell the photographs, commercially license them, claim authorship, substantially alter them for commercial use, or provide them to third parties for commercial or promotional use without written permission from Forbidden Creations Co.
Businesses, vendors, publications, and other commercial entities wishing to use photographs must obtain appropriate permission or licensing from Forbidden Creations Co.
13. SOCIAL MEDIA
Clients are welcome to share their photographs on social media for personal use.
Credit to Forbidden Creations Co. is appreciated when photographs are shared publicly.
Clients are asked not to apply filters or edits that substantially misrepresent the Photographer’s finished work when publicly crediting or tagging Forbidden Creations Co.
14. PORTFOLIO & PROMOTIONAL USE
Any permission for Forbidden Creations Co. to use Client photographs for portfolio, website, social media, advertising, publication, competitions, studio samples, or other promotional purposes will be governed by the Client’s photography agreement or model-release selection.
Where a Client has not granted such permission, Forbidden Creations Co. will respect the applicable agreement regarding the public use of those photographs.
15. CHILDREN & MINORS
A parent or legal guardian must provide any required consent for a minor participating in a photography session.
The Client is responsible for supervising children throughout the session and ensuring their safety.
Forbidden Creations Co. cannot guarantee specific poses, expressions, cooperation, or photographs involving infants, children, pets, or other subjects whose participation may be unpredictable.
16. CLIENT COOPERATION
The Client agrees to reasonably cooperate with the Photographer and to communicate important requests, restrictions, schedules, or circumstances before or during the photography service.
Forbidden Creations Co. cannot guarantee photographs that are prevented by circumstances outside the Photographer’s reasonable control, including Client or guest interference, venue restrictions, officiant rules, delays, weather, lack of cooperation, unavailable participants, restricted access, or changes to an event schedule.
17. WEDDINGS & EVENTS
For weddings and events, the Client is responsible for providing Forbidden Creations Co. with an accurate timeline, locations, addresses, and other information reasonably required to perform the photography services.
The Client should identify important photographs, family combinations, traditions, surprises, or other significant moments in advance whenever reasonably possible.
While Forbidden Creations Co. will make reasonable efforts to photograph important moments, no specific photograph can be absolutely guaranteed due to the unpredictable nature of live events.
18. ADDITIONAL COVERAGE
Photography coverage is limited to the duration purchased by the Client.
If additional coverage is requested on the day of the event, it will be provided only if the Photographer is available and agrees to remain.
Additional coverage will be charged at the applicable rate and must be paid according to the Photographer’s instructions.
19. TRAVEL & LOCATION FEES
Travel fees may apply to bookings outside Forbidden Creations Co.’s standard service area.
Additional costs may include ferry fares, parking, accommodation, permits, admission fees, mileage, or other reasonable travel expenses required to perform the booking.
Applicable travel charges will be communicated to the Client before confirmation whenever reasonably possible.
20. VENUE PERMISSIONS & PERMITS
The Client is responsible for obtaining any permissions required to photograph at a selected location unless otherwise agreed in writing.
Any location, admission, photography, or permit fees are the Client’s responsibility unless specifically included in the package.
21. EQUIPMENT FAILURE, ILLNESS & EVENTS OUTSIDE REASONABLE CONTROL
Forbidden Creations Co. takes reasonable precautions to maintain equipment and protect Client photographs.
However, circumstances outside reasonable control may occur, including severe illness or injury, equipment failure, data corruption, natural disasters, extreme weather, transportation interruption, venue closure, government restrictions, emergencies, or other extraordinary events.
If Forbidden Creations Co. cannot perform the agreed photography services, reasonable efforts may be made to arrange a suitable replacement photographer, reschedule the services, provide an appropriate refund, or reach another mutually acceptable resolution depending on the circumstances.
Nothing in these Terms limits any rights or remedies that cannot legally be excluded under applicable law.
22. LIMITATION OF LIABILITY
To the fullest extent permitted by law, Forbidden Creations Co.’s financial liability arising from a photography booking will not exceed the amount actually paid by the Client to Forbidden Creations Co. for the affected photography services.
Forbidden Creations Co. will not be responsible for indirect, incidental, or consequential losses arising from circumstances beyond the Photographer’s reasonable control.
This provision does not exclude liability that cannot lawfully be excluded or limited.
23. GIFT CERTIFICATES & PROMOTIONAL OFFERS
Gift certificates, promotional pricing, discounts, giveaways, and special offers may be subject to additional conditions communicated at the time they are offered.
Promotions cannot be combined unless expressly stated.
Cash redemption is not available except where required by law.
24. PRICING
Prices are subject to change without notice for future bookings.
Once a booking has been confirmed, the Client’s agreed package price will generally be honoured unless the Client requests changes to the package, coverage, date, location, travel requirements, or other material booking details.
25. DISPUTES
Clients are encouraged to contact Forbidden Creations Co. promptly if they have concerns regarding their booking, service, or delivered photographs so that a reasonable resolution can be explored.
These Terms and any photography agreement are governed by the laws applicable in the Province of British Columbia and the federal laws of Canada applicable therein.
26. SEVERABILITY
If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.
27. ENTIRE AGREEMENT
These Terms supplement the Client’s photography contract, booking information, package description, and invoice.
If a specific signed photography agreement contains a provision that conflicts with these general Terms of Sale, the specific photography agreement will govern to the extent of that conflict, subject to applicable law.
28. ACCEPTANCE
By completing a booking or purchase with Forbidden Creations Co., the Client confirms that they have had an opportunity to review the applicable terms before purchasing and agree to be bound by them.
